General Terms and Conditions for Course and Workshop Enrollment

Berlin Film Community e.V. — Allgemeine Geschäftsbedingungen (AGB)

These Terms and Conditions have been prepared in good faith with reference to applicable German consumer law. They have been reviewed for general compliance but we recommend seeking independent legal advice for any disputes or questions of interpretation.

§ 1 — Provider Information

These General Terms and Conditions govern all contracts for participation in courses, workshops, seminars and other educational events (collectively: "Courses") offered by:

(hereinafter referred to as "BFC" or "we")

§ 2 — Scope and Application

2.1  These Terms apply to all Courses offered by BFC through its website and any other sales channel, and form the basis of every contract concluded between BFC and the participant (hereinafter: "Participant").

2.2  Deviating, conflicting or supplementary terms of the Participant shall not become part of the contract unless BFC has expressly agreed to their validity in writing.

2.3  These Terms apply to consumers within the meaning of § 13 BGB as well as to entrepreneurs within the meaning of § 14 BGB, unless a specific provision is designated as applying to consumers only.

§ 3 — Conclusion of Contract

3.1  The presentation of Courses on the BFC website constitutes an invitation to submit an offer (invitatio ad offerendum) and does not constitute a binding offer.

3.2  By completing the enrollment process and clicking the final confirmation button, the Participant submits a binding offer to conclude an enrollment contract.

3.3  The contract is concluded when BFC accepts this offer by sending an enrollment confirmation email to the Participant's registered email address. BFC reserves the right to reject an enrollment without giving reasons, in which case any payment received will be refunded in full.

3.4  The contract text is stored by BFC and accessible to the Participant via their member dashboard.

§ 4 — Prices and Payment

4.1  All prices stated are total prices. Berlin Film Community e.V. is a registered non-profit association (gemeinnütziger Verein) and is exempt from VAT on its educational activities pursuant to § 4 Nr. 22a UStG.

4.2  The following pricing tiers are available:

4.3  Payment is processed by Stripe, Inc. BFC does not store card data. Payment is due in full at the time of enrollment.

4.4  BFC membership (€30 per year) is a separate contract and is not automatically refundable if the Participant withdraws from a Course.

§ 5 — Right of Withdrawal (Widerrufsrecht) — Consumers Only

5.1 Statutory Right of Withdrawal

If you are a consumer (a natural person concluding a contract for purposes outside your trade or profession), you have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period expires 14 days from the date the contract is concluded (i.e. from receipt of the enrollment confirmation email). To exercise the right of withdrawal, you must inform us (Berlin Film Community e.V., Invalidenstrasse 140, 10115 Berlin, info@berlinfilmcommunity.com) by means of a clear declaration of your decision to withdraw. You may use the model withdrawal form in Annex 1, but this is not mandatory.

5.2 Consequences of Withdrawal

If you withdraw, we will reimburse all payments received for the Course without undue delay and no later than 14 days from the day we are informed of your decision, using the same means of payment you used.

5.3 Early Commencement and Loss of Right of Withdrawal

If the Course commences before the 14-day withdrawal period expires, we will ask you to expressly consent to early commencement at checkout. If you consent and the Course begins before the period expires but is not fully performed, you may still withdraw but must pay a proportionate amount for services provided up to that point.

§ 6 — Cancellation by the Participant

6.1  Cancellations after the withdrawal period, or where the right of withdrawal has been waived, are governed by the following policy:

6.2  All cancellations must be submitted in writing to info@berlinfilmcommunity.com or via our online cancellation form. The date of receipt by BFC is determinative.

6.3  The Participant is free to demonstrate that the actual loss suffered by BFC is lower than the amounts set out above, in which case only the demonstrated loss need be paid (§ 309 No. 5 lit. b BGB).

6.4  Transfer of a place to another person is possible with prior written consent from BFC and is free of charge if requested at least 48 hours before the Course.

§ 7 — Cancellation or Modification by BFC

7.1  BFC reserves the right to cancel a Course if a minimum number of participants is not reached, if the instructor becomes unavailable, or if circumstances beyond BFC's reasonable control make delivery impossible.

7.2  In the event of cancellation by BFC, Participants will be notified as early as possible and the full Course fee refunded. BFC shall not be liable for additional costs (e.g. travel, accommodation) unless caused by BFC's wilful misconduct or gross negligence.

7.3  BFC reserves the right to make reasonable changes to Course content, dates, times, location and instructor. If a material change is unacceptable to a Participant, they may withdraw and receive a full refund of the Course fee.

§ 8 — BFC Membership

8.1  BFC membership (€30 per year) entitles the holder to discounted Course pricing, free attendance at designated member events, and other benefits as described on the BFC website.

8.2  Membership runs for 12 months from activation and is not automatically renewed.

8.3  Membership fees are non-refundable after the 14-day withdrawal period, except where membership was purchased solely to access a specific Course subsequently cancelled by BFC.

§ 9 — Conduct, Participation and Intellectual Property

9.1  Participants are expected to treat instructors, staff and fellow participants with respect. BFC reserves the right to exclude a Participant whose conduct is disruptive or abusive. No refund will be issued in such cases.

9.2  All course materials are protected by copyright and may not be reproduced or shared without prior written consent.

9.3  Photography, video or audio recording during a Course requires the prior consent of all persons present.

§ 10 — Liability

10.1  BFC is liable without limitation for damages resulting from injury to life, body or health caused by BFC or its agents.

10.2  BFC is liable without limitation for damages caused by intentional or grossly negligent breaches of duty.

10.3  For lightly negligent breaches of material contractual obligations (Kardinalpflichten), BFC's liability is limited to foreseeable damage typical for this type of contract.

10.4  BFC's liability for lightly negligent breaches of non-material obligations is excluded.

10.5  The above limitations do not apply to claims under the Produkthaftungsgesetz or other cases where liability cannot be excluded by law.

§ 11 — Data Protection

11.1  Personal data is processed in accordance with our Privacy Policy on the legal bases of contract performance (Art. 6(1)(b) GDPR) and legitimate interests (Art. 6(1)(f) GDPR). Payment data is processed by Stripe, Inc.

§ 12 — Online Dispute Resolution

12.1  The European Commission provides an ODR platform for consumers at: https://ec.europa.eu/consumers/odr

12.2  BFC is not obliged to participate in dispute resolution proceedings and does not generally do so. We encourage Participants to contact us directly at info@berlinfilmcommunity.com in the first instance.

§ 13 — Governing Law and Jurisdiction

13.1  These Terms are governed by the law of the Federal Republic of Germany, excluding the CISG.

13.2  EU consumers also benefit from the mandatory consumer protection provisions of their country of residence where more favourable.

13.3  The courts of Berlin, Germany have jurisdiction for all disputes, to the extent permitted by law.

§ 14 — Miscellaneous

14.1  Should any provision be invalid, the remaining provisions remain in full force. The invalid provision shall be replaced by one that most closely reflects its economic purpose.

14.2  The version in force at the time of enrollment applies to that enrollment.
